These Terms of Service ("Terms") are an agreement between you and Cin Coast Realty ("we", "us", "our"), which operates CinOS, the customer relationship management service for real estate professionals available at cinos.ai and app.cinos.ai (the "Service"). By creating an account, checking the box to agree, or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for a business, you agree on behalf of that business, and "you" includes it.
1. Who may use the Service
You must be at least 18 years old and able to enter into a binding contract. The Service is for business use by real estate professionals and their teams.
2. Accounts and teams
- Keep your sign-in details secure and accurate. You are responsible for what happens under your account.
- The person who creates an account is its account owner. The account owner can invite team members, set their roles and permissions, and is responsible for their use of the Service and for the fees for their seats.
- Tell us right away at the email address below if you think your account has been used without permission.
3. Subscriptions, billing and cancellation
- Plans. Paid plans are billed monthly or annually, as shown when you subscribe. Add-ons, extra seats and one-time purchases are billed as shown at the time of purchase.
- Automatic renewal. Your subscription renews automatically at the end of each billing period, for the same period, until you cancel. We charge the payment method on file at each renewal.
- Payment method. A card on file is required, and payments are collected automatically (autopay). Payments are processed by Stripe.
- Cancellation. You can cancel online at any time in Settings → Billing → Cancel subscription. Cancellation takes effect at the end of the current paid period. You keep access until then, and you are not charged again. Except where the law requires otherwise, fees already paid are not refunded.
- Free trials. If a plan is offered with a free trial, the trial converts to a paid subscription at the end of the trial, and your payment method is charged, unless you cancel before the trial ends.
- Price changes. We may change our prices. We will tell you in advance, and the new price applies from your next renewal after the notice period. If you don't want to pay the new price, you can cancel before it takes effect.
- Taxes. Prices do not include taxes unless stated. Sales tax or similar taxes may apply and will be added where required.
- Late payment. If a payment fails, we will try again and let you know. If a payment is still unpaid 5 days after it was due, we may restrict the account until it is paid: purchases and data export are paused. We may suspend the Service if an account stays unpaid.
4. Your content
- You own your content. Everything you and your team put into the Service, such as contacts, notes, listings, documents, photos, videos and messages ("your content"), stays yours.
- Our license to provide the Service. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, transmit and process your content only as needed to provide, secure and support the Service for you, including showing it on the pages and to the people you choose to publish or share it with. This license ends when your content is deleted from the Service, except for copies kept in backups and version history for the periods described in our Privacy Policy.
- Your responsibility. You confirm you have the rights you need to your content, including permission to upload and publish photos, videos, documents and listing information, and that your content does not break the law or anyone's rights.
- Content Rights Acknowledgment. Every user, including the account owner, admins and each agent, must sign our Content Rights Acknowledgment before using the Service, and again when it changes. By signing it, each user personally confirms that they own or have permission to use everything they upload, import (including from Dropbox and other connected services) or publish through the Service, and accepts personal responsibility for it. The acknowledgment is part of these Terms.
- Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
5. Your clients' information
When you use the Service to manage information about your clients, leads and other people, you decide what is collected and how it is used, and we process it on your behalf as described in our Privacy Policy. You are responsible for:
- having a lawful basis and any consent required to collect, upload, store and contact the people in your account;
- giving those people any privacy notices the law requires;
- responding to their requests about their information. We will help where the Service allows.
6. Messaging rules
You are responsible for every email, text message and call you send through the Service, and for complying with the laws that apply to them, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), state marketing and privacy laws, and carrier and email provider rules. In particular:
- Send marketing email and texts only to people you are allowed to contact. Honor unsubscribe and opt-out requests promptly.
- The Service requires a postal address for marketing email, and includes it with an unsubscribe option. Keep your address accurate.
- If someone has unsubscribed or opted out, you may add them back only if they have given you express consent again. The Service asks you to confirm that before re-subscribing anyone, and you are responsible for that confirmation.
- Text-message opt-outs (such as STOP) are enforced by the phone carriers and cannot be overridden in the Service. The person must text START to opt back in.
7. Acceptable use
You will not use the Service to:
- break any law or regulation, including fair housing, anti-discrimination, consumer protection, privacy, anti-spam and real estate licensing laws;
- publish advertising or listings that discriminate or express a preference based on a protected characteristic;
- break the rules of any multiple listing service (MLS) or data provider whose data you use in the Service;
- infringe or misappropriate anyone's copyright, trademark, privacy or other rights;
- send spam, harass anyone, or upload malicious code;
- collect information from children under 13;
- try to get around the Service's security, access controls or usage limits, probe or test its vulnerabilities, or access another account's data;
- copy, scrape, resell or reverse engineer the Service, except as the law allows;
- interfere with or overload the Service.
We may remove content or restrict access to the Service if we reasonably believe these rules have been broken.
8. Other services you connect
The Service works with services from other companies that you choose to connect, such as Google (Gmail and Calendar), Dropbox, Twilio, Meta, Google Ads, LinkedIn, WordPress, MLS data providers and AI providers. Your use of those services is governed by their own terms and policies. We are not responsible for them, and a feature may stop working if a connected service changes or ends.
9. AI features
Some features use artificial intelligence to draft text or analyze information. AI output can be inaccurate or incomplete. Review it before you rely on it or send it to anyone. You are responsible for what you send or publish.
10. Copyright complaints and repeat infringers
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act, as described in our Copyright Policy. We may remove or disable access to content that is the subject of a notice. We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
When we terminate an account as a repeat infringer:
- Every login on the account, the account owner and all team members, is locked out of the Service.
- Purchases and data export stop.
- Any subscription is set to cancel at the end of the current paid period, so you are not charged again.
If you believe we terminated your account by mistake, contact keegan@cincoastrealty.com.
11. Access to accounts
Authorized CinOS personnel may access account data to provide support, operate and secure the service, or comply with law.
12. Suspension and termination
- You can stop using the Service and cancel your subscription at any time, as described in section 3.
- We may suspend or end your access if you break these Terms, if your account remains unpaid, if we are required to by law, or if your use creates a risk to the Service or to others. We will tell you when we reasonably can.
- After your account ends, we may delete your content, as described in our Privacy Policy. Before it ends, the account owner can download a copy of the account's data in Settings, except while the account is restricted for non-payment. A terminated account can't download its data (see section 10).
13. Changes to the Service and these Terms
We may change the Service. We may update these Terms. The date at the top shows when they last changed. If a change is material, we will tell you through the Service or by email before it takes effect. If you keep using the Service after a change takes effect, the updated Terms apply. If you don't agree, you can cancel.
14. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that data from other providers (such as MLS, property, map or AI data) is accurate or complete. The Service is not legal, tax or financial advice.
15. Limitation of liability
To the fullest extent the law allows:
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities;
- our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
Some places do not allow these limits, so they may not fully apply to you.
16. Indemnity
You will defend and indemnify us against claims, losses and costs (including reasonable legal fees) arising from your content, your messages, your use of the Service, or your breach of these Terms or the law.
17. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Service will be brought in the state or federal courts located in Los Angeles County, California, and you and we consent to their jurisdiction.
18. General
These Terms, together with the policies they refer to, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a right, we don't waive it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
