What a notice must include
To be effective, your notice must be in writing and include:
- Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner.
- Identification of the copyrighted work you say is infringed. If several works are covered by one notice, a representative list of them.
- Identification of the material you say is infringing, with enough information for us to find it. The web address (URL) of each item is best.
- Your contact information: name, mailing address, telephone number and email address.
- A statement that you have a good faith belief that the use of the material in the way complained of is not authorized by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
A notice that is missing these elements may not be acted on. Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are not sure whether material infringes your copyright, consider asking a lawyer first.
What happens after we receive a notice
- We review the notice. If it is complete, we remove or disable access to the material it identifies.
- We let the account that posted the material know, with the notice's reference number, so they can respond.
- We keep a record of the notice and of every action we take on it.
Counter-notices
If material you posted was removed or disabled and you believe this happened by mistake or because the material was misidentified, you can send a counter-notice to our designated agent, or use the counter-notice form. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or that person's agent.
When we receive a valid counter-notice, we send a copy to the person who sent the original notice and tell them that we will restore the material in 10 business days. We restore the material no sooner than 10 and no later than 14 business days after we receive the counter-notice, unless our designated agent first receives notice that the person who sent the original notice has filed a court action seeking an order to stop the alleged infringement.
Repeat infringers
We keep a record of the valid notices we receive about each account. In appropriate circumstances, we terminate the accounts of users who are repeat infringers. We may also remove content or restrict an account before that point when we believe it is appropriate.
